[Abstract] The discrimination in employment is a serious national problem in today's employment field. In recent years this phenomenon is not reduced, instead, has developped a greater diversification such as "sex discrimination", "experience discrimination", "height discrimination" and "region discrimination" etc., thus the laborers are forced to lose the chance to compete for a job under the same level. That strongly abused the right of the citizen in equal employment. Therefore, to complete the Employment Discrimination Law of China has become the key against the discrimination in employment.
This thesis starts with the research of the intention that identifies the discrimination in employment to analyze the defect of the Employment Discrimination Law of China, and then we will present the countermeasures which may improve it by the following steps: First, set the specialized organization; second, check up the laws, rules and the files which are deviated to the constitution; finally, improve the law system of the Employment Discrimination Law of China.
